Australian telecommunications company SpinTel Pty Ltd has paid a $653,400 penalty after sending more than 32,000 marketing emails to former customers without consent, the Australian Communications and Media Authority said on Nov. 4, 2026.

An ACMA investigation found that SpinTel sent promotional messages between July and September 2025 encouraging former customers to return to the company and advertising its NBN and mobile plans. Some recipients had ended their relationship with SpinTel as many as 13 years earlier.

The company argued that consent could be reasonably inferred from its previous business relationships with the recipients. However, ACMA member Samantha Yorke said a former business relationship did not automatically authorize marketing communications, particularly when customers had clearly ended their relationship with the business.

The investigation also found that SpinTel sent five messages more than five business days after recipients had unsubscribed. Alongside the penalty, the ACMA accepted a three-year court-enforceable undertaking requiring SpinTel to appoint an independent consultant, conduct compliance audits and report to the regulator.
