Opticomm Pty Ltd has been hit with a $150,240 penalty by the Australian Communications and Media Authority (ACMA) for failing to adequately notify the authority about planned and completed broadband infrastructure installations across several Australian real estate developments.

The statutory infrastructure provider, known for its wholesale broadband networks, breached industry rules by not informing ACMA of its infrastructure activities in a timely manner. These rules are crucial for ensuring the connection of new premises and the provision of broadband services with adequate speeds.

An investigation by ACMA revealed that Opticomm neglected to provide required notifications on 184 occasions between May 2023 and May 2024. ACMA member Samantha Yorke emphasized the importance of these notification rules, noting that they prevent infrastructure inefficiencies and duplication.

Opticomm attributed the oversight to human error and manual processes that delayed issue detection. Alongside the penalty, Opticomm has agreed to a court-enforceable undertaking to undergo an independent compliance process review and implement recommended improvements. This case underscores ACMA’s commitment to enforcing industry regulations.
